    Credit Counseling & Debtor Education

    Pursuant to 11 U.S. § 109 (h) and Fed. R. Bankr.P.1007(b)(3), individual debtors must complete an approved credit counseling course within 180 days before filing the bankruptcy petition, unless an exception applies.

    • If applicable, the Certificate of Credit Counseling and Debt Repayment Plan must be filed with the petition or within 14 days thereafter.
    • If the debtor is requesting a temporary waiver under § 109(h)(3) (exigent circumstances) or a permanent exemption under § 109(h)(4) (incapacity, disability, or active military duty in a combat zone), the request or certification must be filed with the petition.
