For representation other than a criminal case, such as supervised release, probation revocation and material witness, the local maximum before circuit approval is $2,900. The attorney will need to send a letter to the local judge requesting any amount exceeding the local maximum. In the case of multiple material witnesses the attorney is allowed $2,500 per material witness.

Any request for compensation in excess of the prevailing maximum, either because of the hourly rate or the total amount requested, must be justified by the requesting attorney in a written submission filed with the district judge handling the case. The district judge will forward the fee request to the chief judge of the circuit with a brief written statement recommending approval or denial of the request.
