| Notice and Order That Federal Rule 15, as Made Applicable by Bankruptcy Rule 7015, Shall Apply Whenever an Objection to a Proof of Claim Is Lodged |
|
The Notice and Order will be applicable in every Chapter 7 and Chapter 13 case assigned to Judge Bohm. He urges the consumer bankruptcy bar to carefully review this Notice and Order. Federal Rule 15 will now automatically apply once an objection is filed to a proof of claim. The claimant will not be permitted to amend the claim after the objection is filed unless the claimant first obtains leave of court or, alternatively, obtains the written consent of the objecting party. Sanctions may be imposed against any claimant who, after an objection is filed to the proof of claim, then amends the proof of claim without first having obtained leave of court or the written consent of the objecting party.
