Interim payment claims may be submitted for appointments involving lengthy trials.
Interim payments will be paid for two-thirds of the approved hours and for all approved expenses.
At the conclusion of the representation a final claim shall be submitted seeking payment of the one-third balance withheld from the earlier interim claims, as well as payment for representation provided during the final interim period.
When the total compensation of all interim claims and the final claim are in excess of the statutory case limitation the claims exceeding the limitation must be submitted with a detailed letter addressed to the presiding judge supporting and justifying counsel's claim that representation was provided in a complex or extended case and the excess claimed was necessary to provide proper representation. |
